Tianjin import agent: The new "solid waste Law" learning

It is clear that the country will gradually achieve zero imports of solid waste。

The identification of the property of solid waste entrusted by customs is established in the form of law。

Strengthen the punishment of solid waste crime;At the same time, it is clear that the carrier and the importer bear joint liability (some illegal acts can be fined more than 500,000 yuan and less than 5 million yuan)。

In the form of law, new or clear crackdown measures such as "sealing up, detention", "detention" and "public security management penalties" have been added;New or clear provisions on penalties and fines for relevant management personnel of enterprises。

Under any of the following circumstances, the competent department of ecological environment and other departments responsible for the supervision and management of the prevention and control of environmental pollution by solid waste may seal up or detain the solid waste, facilities, equipment, sites, tools and articles illegally collected, stored, transported, utilized and disposed of。

The original Solid Waste Law has no relevant provisions on sealing and seizure。

Whoever, in violation of the provisions of this Law, imports solid waste from outside the territory of the People's Republic of China into the territory shall be ordered by the Customs to return the solid waste and imposed a fine of not less than 500,000 yuan but not more than 5 million yuan。

The carrier shall be jointly and severally liable with the importer for the return and disposal of the solid waste specified in the preceding paragraph。

According to the provisions of the original Solid Waste Law, the carrier bears the responsibility of returning the goods when the importer is unknown。The new Solid Waste Law directly and clearly stipulates that the carrier bears joint and several liability, increases the obligation of the carrier, and prevents the carrier from staying out of the situation and cooperating with the owner of the cargo。

If, in violation of the provisions of this Law, he commits any of the following acts, which does not constitute a crime, the public security organ shall detain the legal representative, the principal responsible person, the person directly in charge and other responsible persons for not less than 10 days but not more than 15 days;If the circumstances are relatively minor, he shall be detained for not less than five days but not more than 10 days。 

Compared with the original Solid Waste Law, the law enforcement means of detention has been added。
